DIRECTV TiVo Terms and Conditions

ADDITIONAL TERMS APPLICABLE TO YOUR PURCHASE OF A COMPLETE DIRECTV/TIVO FROM WEAKNEES.COM

Please read carefully. Revised 08/01/2005.

WeaKnees.com is an authorized or licensed seller of DIRECTV products. In order to purchase one of these systems at our published prices, YOU MUST AGREE (and by purchasing will be deemed to have agreed) to the following terms and conditions:

1. You must reside in a residential, non-commercial dwelling within the United States and be at least 18 years of age.

2. Activation Requirements. You must activate your DIRECTV equipment with at least the TOTAL CHOICE or OPCION EXTRA ESPECIAL or Higher Package within 30 days. Failure to do so will result in a $225 non-activation fee per receiver. The date of receipt for the purposes of this agreement shall mean the date upon which you or anyone on your behalf receives shipment according to shipping company records. If you purchase a multi-receiver package, all receivers must be activated at the same time.

3. Return Policy. Standard Weaknees.com return policies DO NOT APPLY to complete DIRECTV system purchases. Instead, a fee of up to $50 per receiver may be charged for any refused order or any order marked “Return to Sender.” This charge would be in addition to any restocking fee, and covers weaKnees’ return shipping charges. In addition, you may return your unused, unopened equipment within 30 days, shipped double-boxed at your expense, for a refund less a 15% restocking fee. Units that have been activated with DIRECTV will be subject to a minimum 20% restocking fee, plus $75 for each access card that has been activated. All returned items must be complete and in their original packaging. No item may be returned to weaKnees without a valid return authorization number. Any items returned without an authorization number will be returned to sender.
   

4. Enforcement. Disputes arising out of or relating to your purchase will be brought, heard and determined before and by a court of competent jurisdiction in the State of California, in the County of Los Angeles. You agree that any such court shall have subject matter jurisdiction, personal jurisdiction and venue over all parties to this Agreement without regard to conflicts of laws principles. Any forum selection provision contained in an agreement between the purchaser and DIRECTV shall apply only to disputes between the purchase and DIRECTV.
   
   
5. Additional Terms and Conditions. You hereby expressly give Weaknees.com and any of its partners permission to charge your credit card for any of the charge backs outlined in this agreement. All warranty and service work MUST be performed by WeaKnees.com. If you send your TiVo to the manufacturer for repair, you agree that weaKnees is not responsible for your loss of any additional or add-on products (i.e. upgrade hard drives) installed in your TiVo. Should you fail to activate your receiver(s) or fail to pay weaKnees any of the applicable charge backs provided for in this agreement, you hereby expressly authorize weaKnees to report the outstanding balance due plus all reasonable legal fees to all credit agencies as delinquent.
